Terms and Conditions - Firepit

DISCLAIMER & LIABILITY WAIVER
Effective: July 2026

Burn Design Lab (BDL) and MeadowCreature LLC (MC) are excited to share the first
production models of the smokeless firepit with you. By completing your purchase, you
acknowledge and agree to the following terms:

1. Use at Your Own Risk
• This firepit is an early production model and may not meet final safety or
performance standards.

• BDL and MC disclaim all liability for injuries, property damage, or
environmental harm resulting from:
o Improper assembly, installation, or use.
o Failure to follow safety instructions or warnings.
o Unauthorized modifications or repairs.
o Use in unsafe conditions (e.g., indoors, near flammable materials, or
during high winds).

• You assume all risks associated with using this early production model,
including but not limited to burns, smoke inhalation, or fire hazards.

2. Warranty
• Meadow Creature warrants this firepit against defects in materials and
workmanship for one year from the date of purchase. If a defect appears, we'll
repair or replace the unit at our discretion.
• This warranty does not cover damage from misuse, normal wear, rust from
improper storage, or modifications. As with any open-flame product, use
responsibly and never leave a fire unattended.

3. Indemnification
• You agree to indemnify, defend, and hold harmless BDL, MC, their affiliates,
employees, and partners from any claims, damages, or expenses (including legal
fees) arising from:
o Your use or misuse of the firepit.
o Violations of local laws or regulations.
o Bodily injury or property damage caused by the firepit.

4. Limitation of Liability
• BDL and MC are not liable for:

o Direct, indirect, incidental, or consequential damages (e.g., medical bills,
lost income, or property loss).
o Any claims related to the firepit’s performance, safety, or compliance with
standards.

• In no event shall BDL or MC be liable for any damages.

5. Safety Instructions
• Always follow these guidelines:
o Use outdoors only in a well-ventilated area, away from structures, trees, or
flammable materials.
o Never use the firepit on flammable surfaces, or surfaces that could be
damaged by heat.
o Keep children and pets supervised and at a safe distance.
o Never leave the firepit unattended while in use.
o Allow the firepit to cool completely before moving or storing.
o Dispose of ashes in a metal container with a lid.
• Any failure to follow these instructions is at the user’s sole risk.

6. Governing Law
• These terms are governed by the laws of the State of Washington, USA,
without regard to conflict-of-law principles.

7. Entire Agreement
• This disclaimer constitutes the entire agreement between you and BDL/MC
regarding the firepit. Any modifications must be in writing and signed by both
parties.

By completing your purchase, you confirm that you:
